GENERAL TERMS OF SALE AND INFORMATION
for contracts with consumers
- -The buyer is entitled to withdraw from the contract within seven days after purchase or receipt of the goods in the cases respectively provided for in article 6 of law decree 50 of January 15, 1992.
- -The withdrawal notice should be sent to the vendor at the address stated on the front page by registered mail with advice of receipt. The withdrawal notice may also be sent by telegram, telex or facsimile, provided that it is confirmed by registered mail with advice of receipt within 48 hours.
- -In order to exercise the withdrawal right, it is essential that the goods are in a substantially integral condition.
- -The shipping expenses are payable by the buyer.
- -The price of the goods shall be refunded within thirty days of receipt of the notice of withdrawal or receipt of the goods.
- -Delivery of the goods to the address the buyer declares has a redeeming effect on the vendor.
- -The vendor guarantees the suitability of the merchandise for the purpose for which it is intended as well as its lack of defects. Notwithstanding the provision in presidential decree 224 of May 24, 1988, in accordance with article 1511 of the civil code, the buyer shall report any apparent vices or defects in quality within eight days from receipt of the goods at the domicile under penalty of loss of the right to make use of the guarantee provided for in article 1495 of the civil code.
- -This contract is governed by Italian law. For any dispute, the court having jurisdiction over the buyer’s residence shall be competent if said residence is situated in Italy. In the event the buyer resides outside of Italy, the Court of Milan shall have jurisdiction.
- -In accordance with privacy law 675/96, treatment of the buyer’s data is limited to solely the activities necessary for making the sale and making promotions to the customer in future. The buyer’s data shall not be subject to communication or distribution. Pursuant to article 13 of said law, the buyer may at any time request an update or correction of said data from the vendor and the buyer is entitled on justified grounds to oppose use of said data.
GENERAL TERMS OF SALE
For contracts with professional (non-consumers)
- -Delivery of the goods to the domicile the buyer declares has a redeeming effect on the vendor.
- -The vendor guarantees that the merchandise is suitable for the purpose for which it is intended and that it is free from defects. Notwithstanding the provision in presidential decree 224 of May 24, 1988, in accordance with article 1511 of the civil code, the buyer shall report any apparent vices or defects in quality within eight days from receipt of the goods at the domicile under penalty of loss of the right to make use of the guarantee provided for in article 1495 of the civil code.
- -This contract is governed by Italian law. For any dispute, the Court of Milan shall have jurisdiction.
